The San Francisco Chronicle says that California Democrat Scott Wiener plans to introduce legislation to decriminalize psychedelics, including hallucinogenic mushrooms and DMT, a potent and naturally occurring psychedelic.
Senator Weiner’s plan from last year to end criminal sanctions for possession of psychedelics like LSD, MDMA, psilocybin mushrooms, and mescaline has been watered down into Senate Bill 58. Despite the Senate’s approval of his prior plan, Wiener withdrew it after the Assembly Appropriations Committee stripped decriminalization provisions from the bill.
Unlike the 2020 voter-approved referendum to legalize psilocybin therapy in nearby Oregon, Senate Bill 58 does not authorize the sale of psychedelics and does not provide a regulated framework for the medical and/or supervised consumption of such goods according to a report by Ganjapreneur.
As reported in Forbes, “California SB 58 is an important piece of legislation both for California and the psychedelic industry. We’ve seen a lot of research from UCLA, John Hopkins and other institutions showing the potential of psychedelic-assisted therapy in treating addiction, depression, and PTSD. As the country grapples with a mental health crisis, it’s important to have more treatment options available, and SB 58 decriminalizes natural medicines and creates a pathway for supervised therapeutic use,” said Joshua Kappel, a lawyer with the legal firm Vicente Sederberg LLP that specializes on cannabis and psychedelics.
