$21K Worth of CBD Purchases Will be Refunded

The Federal Trade Commission (FTC) has announced it will refund consumers for CBD products that made misleading medical claims. The agency said it will be refunding 576 people approximately $36 each, totaling $21,000, for products sold by Kushly Industries LLC.

The action appears to be related to a 2021 complaint filed by the FTC that claimed the Arizona-based company said CBD could cure everything from acne to cancer.

The FDA has announced that it will be issuing refunds to customers who have purchased CBD products from companies that have made false health claims. The agency has also stepped up its enforcement of cannabinoids, sending out warning letters to companies selling delta-8 THC and four others to CBD companies making false claims about animals and CBD.

In a press release, the FDA stated, “In addition to the violations related to FDA-regulated products containing delta-8 THC, several of the warning letters outline additional violations of the FD&C Act, including marketing CBD products claiming to treat medical conditions in humans and animals, promoting CBD products as dietary supplements, and adding CBD to human and animal foods. CBD and delta-8 THC are unapproved food additives for use in any human or animal food product, as the FDA is not aware of any basis to conclude that the substances are generally recognized as safe (GRAS) or otherwise exempt from food additive requirements.”
