Ohio’s cannabis industry could be facing significant changes as the Ohio Division of Cannabis Control (ODCC) has proposed a new set of regulations that would restrict certain advertising methods and allow for the sale of pre-rolls at adult-use dispensaries. The proposed rule package, which aims to further regulate the growing market, includes provisions aimed at limiting exposure to younger audiences, as well as introducing new guidelines for dispensary operations.
One of the most notable provisions in the proposed rules is the restriction on advertising methods that have a high likelihood of reaching individuals under the age of 18. Under the new rules, cannabis businesses would be banned from using advertising techniques on billboards, radio, television, and online platforms, which are seen as potentially accessible to younger viewers. The goal is to protect vulnerable populations and ensure that advertising remains responsible and in line with public health considerations.
Pre-Rolls to Be Sold at Adult-Use Dispensaries
In addition to advertising restrictions, the rules would allow the sale of pre-rolls and “super pre-rolls” (flower pre-rolls infused with concentrates) at state-licensed adult-use dispensaries, further expanding the range of products available to consumers. However, the new rules also make a key distinction between adult-use and medical dispensaries: pre-rolls would not be sold through medical dispensaries, as the state currently prohibits smokable products for patients under the medical cannabis program.
Tom Haren, a spokesperson for the Ohio Cannabis Coalition, a key trade organization for the cannabis industry, expressed optimism about the proposed changes, although the group is still reviewing the details. He acknowledged the efforts of the Ohio Division of Cannabis Control in quickly moving to finalize rules and regulations, especially in transitioning from medical-only policies to those allowing dual-use dispensaries that serve both medical and recreational users.
“The industry continues to appreciate the speed in which the division is promulgating some of these final rules packages, and working with the industry to continue to transition away from medical-only rules, and to get these 10B (dual medical and recreational) dispensaries licensed and allowing us to serve the dual-use market,” Haren said in a statement to Cleveland.com.
Discount and Return Policies for Dispensaries
The proposed rule package also includes provisions regarding the operations of dispensaries, specifically concerning discounts and returns. Dispensaries would be required to have a written discount policy, ensuring that any discounts provided to adult-use customers would also be extended to medical cannabis patients. Furthermore, the rules prohibit dispensary employees from receiving any rebates or discounts. This move is intended to ensure fairness and transparency within the retail environment.
In addition to the discount policy, dispensaries would be required to establish a clear written return policy. Under the proposed rules, dispensaries must accept returns for defective products, products that do not match what was indicated on the receipt, or items that are mislabeled, offering consumers a safeguard against faulty transactions.
