Massachusetts Cannabis Control Commission Classifies Ground Cannabis Dust as Hazardous Material

The Massachusetts Cannabis Control Commission (CCC) has issued new health and safety guidelines for the cannabis industry, designating “ground cannabis dust” as a hazardous material. This new regulation comes nearly three years after the tragic death of 27-year-old Lorna McMurrey, a cannabis worker who died from an asthma attack while working at a Trulieve cannabis processing facility in Massachusetts. The company later settled with the Occupational Safety and Health Administration (OSHA) for $14,502 over the incident.

In the official bulletin, the CCC emphasizes that all cannabis licensees should recognize ground cannabis dust as a hazardous chemical. OSHA has previously cited cannabis operators who failed to properly evaluate and classify the risks associated with this dust, including potential skin and respiratory sensitization caused by allergens during marijuana processing. The CCC urges operators to assess workplace safety and ensure compliance with proper health protocols.

The CCC also reminded cannabis operators that they are required to follow state law, which mandates written safety procedures and necessary steps to protect employees from health hazards. This includes adhering to the Occupational Safety and Health Act of 1970, which is overseen by OSHA.

In addition to the new guidelines, the CCC recently imposed fines totaling $165,000 on two of Massachusetts’ largest cannabis companies, Curaleaf and Ascend Wellness, for violations related to pesticide use and failure to comply with the state’s seed-to-sale tracking program.

As the cannabis industry continues to grow, the CCC is reinforcing its commitment to workplace safety, reminding operators of their responsibility to protect their employees from hazardous materials and ensure compliance with all regulations.
